Court Stops 18 LG Chairs’ Suspension By Edo House Of Assembly
An Edo State High Court sitting in Benin has barred the Government of Edo State from stopping the suspended 18 local government chairmen and their deputies from performing their duties.
The 18 local council chairmen suspended by the Edo State House of Assembly had approached the Court seeking an order against the implementation of the suspension.
“An order of injunction restraining the defendants by themselves their privies. servants, agent, howsoever named or described from in any way giving effect to or acting on the resolution suspending the claimants’ elected Chairman/Vice Chairmen purportedly made by the Edo State House of Assembly on the 16/12/2024 or any other day, pending the hearing and determination of the Motion on Notice in this suit filed on the 12/12/2024,” one of the prayers read.
The Court while ruling on Suit No B/307/OS/24, on Friday, granted the prayers of the 18 council chairs.
In his ruling, Hon. Justice Efe ordered the Edo State government not to effect the suspension resolution.
“The Defendant by their privies servants, agents howsoever called are hereby restrained from, in any way giving effect to, or acting on the resolution suspending the Claimants elected Chairmen and Vice Chairmen, made by the Edo State House of Assembly on 16/12/24 or any other day, pending the hearing and determination the Motion on Notice filed on the 12/12/24,” Justice Efe ruled.
Justice Efe adjourned the case to 17th February 2025 for further hearing.
