Victory Is Sure Against Impostors In African Action Congress With Adjournment Of Appeal—Party Spokesman
The African Action Congress (AAC) has expressed confidence in an appeal filed by the National Chairman of the party, Omoyele Sowore against a judgment delivered by a Federal High Court Abuja on the leadership of the party.
Sowore is asking the Appeal Court to set aside the judgment of the Federal High Court delivered by Justice Inyang Ekwo which declared Leonard Nzenwa as Acting National Chairman on the ground of lack of jurisdiction, breach of fair hearing and improper evaluation of evidence.
The AAC, in a statement signed by its National Publicity Secretary, Femi Adeyeye on Wednesday described the declaration of Nzenwa as Acting National Chairman of the party as illegality.
The statement read, “The African Action Congress (AAC) wishes to inform all members and the public of its appeal against the furtherance of illegality under the supervision of Professor Mahmoud Yakubu’s Independent National Electoral Commission (INEC), which came up for hearing today November 10, 2021, at the Court of Appeal, Abuja.
“As a party that believes in democratic tenets and the principles of separation of power, we have approached the Court for a redress of a ruling against the order of leadership which was sponsored by some disgruntled and fraudulent elements who were expelled from the party through constitutional and democratic means.
“The National Legal Adviser, Inibehe Effiong (Esq.) while addressing the press today made it clear that victory is at sight and that neither of the defendants (Leonard and INEC) has filed a counter-argument to the appeal.

“However, we also wish to state that we are not oblivious of the oppressive and exploitative system we are up against, whose judicial mills grind slowly when it concerns pro-people political alternatives such as ours. But the mill gets overtly energized when it concerns those who have ruined our space and have cornered our resources for the solidification of their political hegemony.
When it concerns them, the judiciary can have ‘day and night shifts’, as experienced in many cases of the APC (All Progressives Congress) and PDP (Peoples Democratic Party). We demand that our matter be given a speedy hearing for the sake of justice.
“The National Working Committee of the party led by Mr Omoyele Sowore is confident that the imposters who are mere willful tools in the hands of our oppressors would soon run out of gas, as the people of Nigeria are mobilized against their agenda.
“Onward to victory.”
At the resumed hearing of the case on Tuesday, Effiong moved an application to amend the Notice of Appeal and Brief of Argument.
He said the application was filed on October 14, 2021, just as he moved for the withdrawal of the one filed on 7th July 2020.
The application was not objected to by the counsel for the 1st respondent, Obed Agu.
INEC which is the 2nd respondent was not represented in the court.
After the submissions by the parties in the matter, the three-man panel headed by Justice A.J. Adah, therefore, granted the prayer as requested by Inibehe, struck out the earlier application and granted the fresh application.
He thereafter adjourned the case to February 22, 2022, for the hearing of the appeal.
